Warranty and Liability
WARRANTY FOR HARDWARE:
TicrTech hardware products are warranted against faulty parts, manufacturing defects, premature component failure and bad workmanship for a period of twenty four months from the date of shipping from TicrTech. TicrTech will either replace or repair the failed or defective component(s) or will replace said equipment free of charge. The customer must bear all costs for freight and transport of the equipment back to TicrThing / TicrTech. TicrThing / TicrTech shall not be liable for consequential damages resulting or arising from equipment failure or any resulting data corruption.
WARRANTY FOR SOFTWARE/FIRMWARE:
There is absolutely no warranty for TicrThing / TicrTech software/firmware products. TicrTech software/firmware products are provided to you, the customer, as part of the TicrThing product on an "as is" basis without any warranty what so ever. TicrTech hereby disclaims all warranties, express and implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, use, accuracy, title or non-infringement. In addition, TicrTech makes no, and hereby specifically disclaims any warranty, that the software/firmware will meet your requirements, or that your use of the software/firmware will be uninterrupted, timely, secure or error free; nor does TicrTech make any warranty, and TicrTech specifically disclaims all warranty, as to the results that may be obtained from the use of the software/firmware or that defects or errors in the software/firmware will be corrected. In no event shall TicrTech be liable to you for direct, indirect, consequential, special, punitive or incidental damages or lost profits, whether foreseeable or unforeseeable, even if any representative of TicrTech has been advised of the possibility of such damages (including, but not limited to, claims for loss of data, goodwill, use of money or use of TicrTech products, interruption in use or availability of data, stoppage of other work or impairment or other assets), arising out of breach or failure of warranty or condition, breach of contract, misrepresentation, negligence, strict liability in tort, or otherwise.
